LEWISTOWN, Pennsylvania -- Two police officers were justified in using deadly force, according to an investigation by state police at Huntingdon.

The officers will not be publicly named or charged in the police officer-involved shooting death of Charles Bossinger, Mifflin County District Attorney Chris Torquato said in a statement.

Bossinger, 53, died April 26 when he was shot multiple times on Oakland Avenue in Lewistown borough. The Lewistown police officers responded to the area after a 5:20 p.m. 911 call indicated Bossinger had threatened to shoot himself with a rifle and shots had been fired in an Oakland Avenue residence.

State police at Huntingdon spearheaded the shooting investigation, which Lewistown police were not involved in.

The investigation revealed more than a dozen rounds were fired in the residence, and the several rounds fired by police were accounted for outside the residence, according to Torquota. "A large number of witnesses" reported hearing commands to "put down the gun," "drop it" and "drop your weapon" prior to the shooting.

Bossinger allegedly exited the residence, walked away, struck a police vehicle, walked toward his residence and then encountered two police officers, according to Torquota. Bossinger was about 20 feet away from two police officers when one of the officers lost his footing and fell. The gunman allegedly ignored commands to drop the weapon and instead pointed a firearm at the downed police officer at 6 p.m., which is when the pair of police officers shot him.

"It is clear both officers feared immediate serious bodily injury or death would occur at the time they utilized deadly force in the discharge of their service weapons," Torquato said.
